wrongful death Article
When someone dies or becomes seriously injured because of the acts or negligence of another, it is one of the most traumatic events that a family can endure. Families often do not consider hiring a lawyer immediately after suffering such a profound loss; however, the time immediately after such a tragedy can be a crucial time to insure the strength of a wrongful death or serious injury case.
For example, this tragedy will be imprinted on witnesses’ recollections immediately after the event; but, over time, witnesses’ recollections fade and the attempt to rekindle those memories might not be successful. “Pictures are worth a thousand words”, it is said, and that phrase describes the power of photographs taken at the scene at the time of an injury, vehicle photographs, and injury photographs.
The laws governing the time in which a family can bring a wrongful death case or a serious personal injury case varies from state to state. These laws are called statutes of limitation. If a case is not brought within that time period it can never be brought. In some states families must bring their cases within 1 year from the injury, in other states families have more time in which to bring the case.
I have tried wrongful death cases to juries in Arizona, Iowa, and in Minnesota. I have resolved wrongful death or serious injury cases in Iowa, Minnesota, Nebraska, North Dakota, Oklahoma, South Dakota, and Wisconsin.
